3. User Accounts and Registration

2. Account Security: You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must use a strong, unique password.

• You acknowledge that you do not acquire any ownership interest in the underlying technology or intellectual property of Facing AI.
• Your Content: You retain ownership of the original images you upload. The processed output images generated using our AI tools are yours to use in accordance with these Terms.
• You grant Facing AI a limited, non-exclusive license to process your uploaded content solely for the purpose of providing the service.

5. AI-Generated Content and Usage Rights

• Output images created with Facing AI may be used for personal and commercial purposes, subject to applicable laws and these Terms.
• You are solely responsible for ensuring that source images you upload do not infringe on any third-party rights, including copyrights, trademarks, personality rights, or rights of publicity.
• You must not use Facing AI to create content that is misleading, defamatory, or intended to deceive others about the identity of any individual.
• You acknowledge that AI-generated outputs may sometimes produce unexpected or imperfect results. Facing AI is not liable for the quality or accuracy of AI-generated content.

6. Prohibited Activities

You agree not to engage in any of the following while using Facing AI:

• Creating deepfake content intended to deceive, harass, defame, or impersonate any individual
• Generating non-consensual intimate imagery or any form of illegal content
• Unauthorized access to, reverse engineering, or distribution of our proprietary code, AI models, or systems
• Reselling, sublicensing, or redistributing Facing AI services without written authorization
• Interfering with or disrupting the security, integrity, or performance of the service
• Using the service for any illegal, fraudulent, or unauthorized purpose
• Attempting to bypass any security features, rate limits, or access controls
• Uploading images that infringe on third-party copyrights, trademarks, or rights of publicity
• Using automated tools (bots, scrapers) to access the service without prior written consent
• Transmitting malware, viruses, or other harmful code through the service

Violation of these prohibitions may result in immediate account termination and potential legal action.

7. Privacy and Data Collection

8. Pricing and Payments

• All purchases are final and non-refundable unless otherwise required by applicable law or our refund policy.

• Subscription plans automatically renew unless cancelled before the renewal date.

WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

11. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, FACING AI AND ITS AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICE. OUR TOTAL AGGREGATE LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID TO FACING AI IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

12. Indemnification

You agree to indemnify, defend, and hold harmless Facing AI, its affiliates, and their respective officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from: (a) your use of the service; (b) your violation of these Terms; (c) your violation of any third-party rights; or (d) any content you upload or generate through the service.

13. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Facing AI operates, without regard to conflict of law provisions. Any disputes arising from these Terms or the service shall first be attempted to be resolved through good-faith negotiation, and if unsuccessful, through binding arbitration in accordance with applicable laws.

14. Changes to These Terms

We reserve the right to update or modify these Terms at any time. When we make material changes, we will revise the "Effective Date" at the top and notify you via email or in-app notification. Your continued use of the service after changes take effect constitutes your acceptance of the revised Terms.

15. Severability
